Zusammenfassung:	PURPOSE: A torque restricting device and method of the vehicles are provided to reduce the exhaustion of the exhaust gas by repairing the malfunction since the operator of the vehicles can recognize the malfunction generated in all kinds of the sensors mounted on vehicles or all kinds of the actuators. CONSTITUTION: The torque restricting device of the vehicles includes; a torque restriction(100) generating the torque qualifier signal which diagnoses the trouble occurred in the actuators and sensors mounted on vehicles and restricts the torque of the engine when the trouble occurrence is diagnosed; a torque control signal created the accelerating pedal according to the step on; a torque selecting unit(110) selecting the value having a small size of the torque qualifier signal as the torque signal; an air volume controller(120) generating the air volume control signal, restricting the air volume of the throttle according to the torque signal which the torque selecting unit selects; and a control part of ignition timing(130) generating the ignition control signal, controlling the ignition timing of the engine according to the torque signal which the torque selecting unit selects.
