Zusammenfassung:An image photographing apparatus and an image photographing method are provided to limit the number of static image data to be recorded in a recording medium under a predetermine maximum number. A static image data generating unit(24) converts a captured light into an electric signal and generates static image data expressing the static image from the electric signal. A recording unit(40) records the static image data on a recording medium. A unit for recognizing free capacity recognizes free capacity of the recording medium. A parameter determination unit is set about the static image data generating unit and determines a parameter for adjusting a data amount of the static image data.
