To provide an image recording device capable of highly precisely recording an image of a dangerous vehicle, and an image recording method.SOLUTION: An image recording device comprises a detection section, a determination section, and a storage processing section. The detection section detects another vehicle existing by the side of an own vehicle on the basis of an image picking up a periphery of the own vehicle with an imaging apparatus. In a case where a distance between the other vehicle detected by the detection section and the own vehicle becomes shorter than a predetermined threshold, the determination section determines that the other vehicle is performing dangerous driving upon the own vehicle.
