PROBLEM TO BE SOLVED: To provide a semiconductor element having high characteristics; and provide a semiconductor device with the semiconductor element.SOLUTION: A semiconductor element comprises: an element region having a semiconductor layer including a channel part and an element peripheral region adjacent to the element region; a gate electrode which is provided in the element region and has a boundary part that bridges over the element region and the element peripheral region; a conductive layer between the gate electrode and the semiconductor layer; and an insulation layer between the gate electrode at the boundary part and the semiconductor layer.
