Zusammenfassung:	PROBLEM TO BE SOLVED: To provide a mistaken staple recovery device and an image forming device having this device, capable of easily disposing of a mistaken staple from a mistaken staple recovery tray when moving the mistaken staple recovery tray, and of surely holding the mistaken staple regardless of a current-carrying state of the device. SOLUTION: This mistaken staple recovery device has a staple device processing a paper bundle by a staple, the mistaken staple recovery tray arranged under the staple device and a permanent magnet sticking the mistaken staple, and has a magnetic substance in a position opposed to the permanent magnet of the mistaken staple recovery tray, and is constituted so that the permanent magnet is fixed together with the staple device, and the mistaken staple recovery tray is movably held.
