PROBLEM TO BE SOLVED: To provide a data recording and reproducing device capable of easily and accurately reproducing a summary or searching an optional scene of contents data desired by a user by making hierarchical structure of moving image data in each partial contents data on the basis of a telop. SOLUTION: The data recording and reproducing device 100 detects changed parts of extracted telop data, and when at least two or more changed parts are detected from one or two or more pieces of telop data, the data recording and reproducing device 100 detects the number of changed times of each detected changed part and change points in each detected changed part. In addition, the data recording and reproducing device 100 sets a hierarchical level of each changed part on the basis of the detected number of changed times of each changed part, generates index data showing indexes of a plurality of scenes in the contents data on the basis of the set hierarchical level of each changed part and the detected change points of each change part, and reproduces the contents data on the basis of the generated index data.
