DIREITO REAL, PROPRIEDADE INTELECTUAL E FUNÇÃO SOCIAL:UM DIÁLOGO DE NATUREZA INDISCIPLINAR

The present study aims to understand the historical context of the emergence of both material and intellectual property and its linkage with the social and economic phenomenon, markedly the resulting conflicts between private interests and the need to preserve the social function of property, notably intellectual property. As a main result it is shown that intellectual property, conditioned to the social function, is even more functional, socially responsible and less full than any other form of property. The deductive method was used as well as the technique and methodological procedure, indirect documentary research with bibliographical survey and article redings.
