Cesty k suverenitě lidu: nástin genealogie jednoho konceptu

To understand properly basic concepts of contemporary constitutional democracies, it is necessary to study them from both the genealogical and architectonic perspective. This article is the second piece of the larger intellectual project focusing on the concept of sovereignty. It deals with the historical and conceptual development from the legislative conception of sovereignty to the concept of sovereignty of people which is the matrix of current debates about this corner stone of the edifice of modern legal and political systems. In its first part, the article explores especially the idea of representation how it was coined by English philosopher Thomas Hobbes. In its second part, the process of the invention of modern constitutionalism is thoroughly analyzed. The article is approaching its climax in the analysis of the work of French constitutionalist abbé Sieyès who was the first big theorist of the concept of constituent power.
