Zusammenfassung:This research addresses the recent accession of Brazil in the United Nations Convention on Contracts for the International Sale of Goods (CISG), and investigates the possible conflicts with national laws when contracts are celebrated in the electronic environment (e-commerce). This paper will also examine the application of the CISG in the contracts that involve multinational companies, especially those who own their site´s domains in several countries. Therefore, this study analyzes the possible exclusion of these consumption contracts and utilizes as a basis the Finalist Mitigated Theory. However, this issue will generate controversy with the recent Senate’s Bill N. 281/2012, which wants to modernize the CDC – as it extends the consumer´s protective rights to the international scope of e-commerce.
