A justiça como parâmetro do governo: o Conselho de Governo e o Conselho Geral na província de Minas Gerais (1825-1834)

Resumo: Neste artigo, analisarei as dinâmicas institucionais dos Conselhos de Governo e dos Conselhos Gerais, instituições criadas nas províncias do Império em meio ao processo de emancipação política do Brasil, partindo, para tanto, de suas atuações na província de Minas Gerais entre 1825 e 1834. O objetivo será elucidar as lógicas de funcionamento interno dos Conselhos provinciais e as relações estabelecidas com outros agentes e instituições da administração pública e com a sociedade de maneira mais ampla. A partir da problemática da modulação e do exercício da autoridade, a análise baseou-se em três aspectos inter-relacionados: a composição e a dinâmica do expediente; o modus operandi que sustentava e buscava assegurar a legitimidade de suas resoluções; e, por fim, as relações de ordem-obediência, perpassadas pelo princípio da adesão, estabelecidas entre essas instituições e os empregados públicos e demais agentes destinatários de suas resoluções.. Abstract: This article analyzes the institutional dynamics of the Government Councils and the General Councils, institutions created in the provinces of the Empire in the midst of the process of political emancipation of Brazil, based on their activities in the province of Minas Gerais between 1825 and 1834. My goal will be to elucidate the rules of internal operation in the Provincial Councils and the relations established with other agents and institutions of public administration and with society in general. Departing from the problem of modulation and of the exercise of authority, the analysis were based on three interrelated aspects: the composition and the dynamics of the operations in the councils; the modus operandi that sustained and sought to ensure the legitimacy of its own resolutions and, finally, the order-obedience relations, permeated by the idea of adherence, established between these institutions and the public servants, as well as other agents to whom their resolutions were addressed.
