This article deals with a detailed analysis of the current context regarding the crisis of the penitentiary system that our country is facing, through the historical specification of the penitentiary system, which will allow laying the foundations to analyze the emergence of the problem; It will also show the events that occurred from February 2021 to the present, a period of time, in which nine massacres and several confrontations between criminal gangs inside prisons have taken place, delving into the determining factors for said crisis to continue. grade; Within the analysis, the responses given by the State will be detailed, as the entity in charge of guaranteeing and promoting rights, in addition to ensuring and safeguarding the security that surrounds citizens. El presente artículo aborda un análisis detallado del contexto actual referente a la crisis del sistema penitenciario que afronta nuestro país, a través de la puntualización histórica del sistema penitenciario, el cual permitirá sentar bases para analizar el surgimiento de la problemática; también se mostrará los hechos ocurridos desde febrero de 2021 hasta la actualidad, periodo de tiempo, en el cual se han suscitado nueve masacres y varios enfrentamientos entre bandas delincuenciales en el interior de las cárceles, profundizando en los factores determinantes para que dicha crisis siga en curso; dentro del análisis, se detallará cuáles han sido las respuestas dadas por parte del Estado, como ente encargado de garantizar y promover derechos, además de velar y resguardar la seguridad que envuelve a los ciudadanos.
