Zusammenfassung: | Migration is an internationally recognized constitutional right, however, its exercise, the restrictive
measures established by the States and the requirements that must be met lead the migrant to
become a victim of illicit trafficking. Faced with this social problem that Ecuador faces, the
objective outlined in the investigation was to analyze the situation of the smuggling of migrants,
addressing in a special way its repercussions in Ecuador. The methodology implemented was
through the rationalist epistemological paradigm, from the reasoned experience of the researcher
and the knowledge provided by the national and international scientific literature; Regarding its
level of scope, it was descriptive and with a qualitative approach, proceeding to carry out a
reflective analysis and interpretation of the legislation and the international legal framework that
regulates the subject of study, using for this, the analytical-synthetic methods and hermeneutics.
