Freedom of speech and hate speech: an american perspective

Freedom of speech is a fundamental right in the United States, however, it is not unlimited. Although the Supreme Court initially supported the government in its pursuit of speech limitation, more recently the Court has positioned itself as the protector of the First Amendment rights. The Court prevented the government from regulating speech on the basis of content and provided strict parameters regarding the lack of protection of freedom of speech. The article aims to examine the evolution of the US jurisprudential understanding and how the idea of hate speech fits into the often ambiguous categories established in the decisions. A liberdade de expressão é um direito fundamental nos Estados Unidos, no entanto, não é ilimitado. Embora inicialmente a Suprema Corte tenha apoiado o governo na busca pela limitação do discurso, mais recentemente, o Tribunal se posicionou como o protetor dos direitos da Primeira Emenda. A Corte impediu que o governo regulasse o discurso com base no conteúdo e forneceu parâmetros restritoss em relação à ausência de proteção da liberdade de expressão. O artigo objetiva examinar a evolução do entendimento jurisprudencial norte-americano e como a ideia do discurso de ódio se encaixa nas categorias frequentemente ambíguas estabelecidas nas decisões.
