O direito à morte digna: a busca de uma resposta para um choque de princípios

This article deals with the right to obtain a dignified death. To do so, the research was structured analyzing the terms, concepts, characteristics, besides the issues originated from the collision of principles related to this field. Therefore, this article analyzes the difference between rules and principles in Dworkin and Alexy's doctrine. Consequently, it raises the question of weighting, elucidating its effects based on the formula proposed by Robert Alexy. At the end, we verified that it is necessary to safeguard the dignity of the terminal patient undergoing futile treatments that do not make any improvements to the individual, in order to establish the right to a dignified death as a universal human right. O presente artigo trata do direito à morte digna. Para tanto, a pesquisa foi estruturada analisando-se os termos, conceitos, características, além da problemática originada a partir da colisão de princípios relacionados ao instituto. Por conseguinte, realiza uma análise da diferença entre regras e princípios na doutrina de Dworkin e Alexy. Por conseguinte, apresenta a questão da ponderação, elucidando os seus efeitos a partir do que dispõe a fórmula proposta por Robert Alexy. Ao final, foi verificada a necessidade de resguardar a dignidade do paciente terminal diante de tratamentos fúteis, que não possibilitem melhorias ao indivíduo, no intuito de estabelecer o direito à morte digna como um direito humano universal.
