Zusammenfassung: | This article has as its purposes address, briefly, the
adhesion of Brazil to the Kimberley Process Certificate System
(KPCS) in the perspective of the Security Council of the United
Nations. It aims to provoke some reflection about the need for
a new adaptation of this mechanism in the Brazilian mining
business in order to control, or otherwise, reduce the secular
problem of illicit internal production which illegally encourages
the export market of diamonds. In addition, we will analyze
the impacts of this international procedure which has created
a diamond market reserve whereas the legalization through
the administrative procedurethat results in the issuance of the
Kimberley Process Certificate (KPC) cancels and withdraws the
Brazilian diamond production from the international market. As
the administrative procedure which is being handled in federal
agency, it remains to set the jurisdiction of federal courts to
control the legality of the process and the validity of the act of
issuance of the CPK. After the study, it was found that, despite
the introduction of the national KPCS to promote some positive
changes and reveal the beginning of an action for the control of
trade Brazilian mining business, the administrative procedure
that results in the issuance of the certificate scheme requires new
and effective interventions to effectively control illegal diamond
trade, as well as advance in the regular production recovery,
elevating brazilian diamonds to development and prosperity of
the nation as a whole.
A proposta com este artigo é abordar, resumidamente,
a adesão do Brasil ao Sistema de Certificado do Processo de
Kimberley (SCPK) sob a exegese do Conselho de Segurança das
Nações Unidas. Objetiva-se refletir sobre a necessidade de nova
adequação desse mecanismo ao mercado minerário brasileiro
para controlar o secular problema da produção ilegal interna
que fomenta o mercado internacional ilícito de diamantes. São
analisadas as repercussões desse instituto, que criou reserva
internacional no mercado de diamantes que favorece os países
ricos, ao passo que a própria legislação brasileira anula sua própria
produção de diamantes, retirando-os do mercado internacional, sob
o falso pretexto de defender os direitos humanos. A competência
para o controle da legalidade do ato administrativo para a
emissão do CPK é da Justiça Federal, dada sua processualização
