Zusammenfassung:This paper is aimed at analysing the closed penitentiary regime in Spain. It has been partially fostered by the celebration of the 40th anniversary of the passage of the first democratic prison act (LOGP for their initials in Spanish). From this starting point, this article delves into the reasons driving the creation of the closed prison regime, as well as the arguments that have legitimised it, impeding its abrogation, over this four-decade period. El objetivo de este artículo reside en efectuar un análisis del primer grado penitenciario. La aparición de este trabajo se justifica, entre otros motivos, por la efeméride que supone el 40 aniversario de la LOGP que se produce en 2019. Así pues, en este marco, se intenta mapear las razones que impulsaron la creación del primer grado penitenciario, los argumentos que justificaron su procedencia y que permiten afirmar que sigue siendo un grado clasificatorio vigente.
