Zusammenfassung: | This article examines the new EU hazardous waste list (reproduced at [I9951 EELR 91), and argues that the list is fundamentally flawed and should be revised. The article begins with a brief review of underlying EU legislation, including a short description of the relationships between the sundry waste and hazardous waste definitions and lists. The article then focuses on Directive 911689 on hazardous waste, and sets out the basic EU definition. The article goes on to describe an aborted attempt to modify this directive. It next focuses on the Council decision adopting the EU Hazardous Waste List pursuant to this directive, and discusses the list's practical implications and legal validity.' The article concludes by recommending that the EU replace the existing list with a more limited, and carefully considered list. |
