Zusammenfassung: | The number of cases in which civil servants engaging in an activity that involves exercise of public authority are passive subject of the offense of outrage, being humiliated, thus contributing to the prejudice of authority and to the loss of confidence by the population in the state's ability to come to meet their needs, gave rise to the question if the Romanian society has triggered a crisis of authority that comes in contradiction with the principles of rule of law. Among the causes which contribute to many examples of outrage against public representatives, should be, on the one hand, lack of tact and firmness and on the other hand, must be specified faulty in which individuals understand their right to challenge acts of civil servants invested with authority exercise, behavioral deficiencies and a legislation sometimes daunting at all. Because in a democratic society citizens are becoming more critical and more demanding in terms of civil servants' behavior, their activity must conform with the law and with society’s needs to be protected by the criminal law. |
