Zusammenfassung: | The authors tends to present a new European initiative relating to the application of the principle of mutual recognition, which will facilitate the collection and transfer of evidence between Member States in criminal matters. Bearing in mind the discussions on the free movement of evidence in criminal matters, the authors try to focus on the basic elements of the principle of mutual recognition of decisions in criminal matters. In this connection, the authors first discuss about the European Evidence Warrant and the European Investigation Order, which are at the level of the European Union adopted pursuant to this principle, pointing out the differences between these instruments. |
