ORDINUL DE PROTECŢIE – INSTRUMENT DE PROTECŢIE A VICTIMELOR TUTUROR FORMELOR DE VIOLENŢĂ

The protection order, originally regulated by Law no. 217/2003 on preventing and combating domestic violence and applicable only to victims of domestic violence, may be issued, as of 31 August 2024, the date of entry into force of Law no. 26/2024 on the protection order, and for the protection of any person who is subjected to acts of violence whether they occur in the domestic or non-domestic environment and regardless of the status of the aggressor towards the victim. In society, violent behavior does not only occur in the family, but can occur in all types of relationships a person enters into. Starting from the fact that the need for protection against aggression that may endanger a person's life or his/her physical or mental integrity or freedom is a general one and that the protection order has already proved in practice to be an effective means of protection, the legislator considered it appropriate to adopt this new normative act which regulates the conditions and procedure for issuing the protection order in a similar way to the provisions of Law no. 217/2003.
