Zusammenfassung:The new Romanian Pre-university Education Law provides for the possibility of audio-video surveillance of the primary beneficiaries – the pupils – in the classrooms themselves. The same law also provides that audio-video surveillance cameras will not be installed in classrooms where the majority of parents express their disagreement, in writing, within the educational contract. On the one hand – according to the Methodological Norms for the application of Law no. 333/2003 regarding the protection of objectives, assets, values and the protection of persons – pre-university education units as institutions of public interest have the legal obligation to ensure the fulfillment of minimum security requirements through video surveillance systems in access ways, hallways and other high-risk areas. On the other hand, the installation of the audio-video surveillance system provided for by art. 66 of the Pre-University Education Law is optional. Therefore, the present study aims to highlight a possible violation of the right to private life of both students and teachers, fundamental right protected under Article 8 of the European Convention on Human Rights.
