Zusammenfassung:The use of video surveillance in the workplace is mainly examined in relation to effectively ensuring respect for fundamental human rights and reducing the possibility of employers’ abuse. However, it should be borne in mind that employers may use video monitoring systems to comply with legal obligations or to satisfy their legitimate interests. In this case, employers must be able to prove that a number of conditions are met, which result either from legal provisions or from case law interpretation. However, as will be demonstrated in this article, the case law of the various authorities with competence in this area is uneven, which hampers compliance with the legal provisions and creates a situation of legal uncertainty and lack of predictability for employers, with consequences for the respect of data subjects' rights.
