Лейла Алиева Summary The monograph “The Constitutional-Legal Bases of NationalState Interests of the Republic of Azerbaijan” is devoted to the formation, realization and protection of national-state interests of our country. Modem Azerbaijan is going through a difficult period of its history, accompanied by profound transformations both in the economic and political spheres, and in the sphere of state building. On July 27, 2016, the President of Azerbaijan took advantage of his right enshrined in Art. 109 of the Constitution, appointed on September 26 of this year a referendum on the issue of amending the Constitution of Azerbaijan. The country at the constitutional level at the referendum reformed the system of executive power by strengthening the executive vertical, which will allow to respond more quickly to complex modem challenges. As international and domestic experience suggests, the guiding principle in these conditions is the right combination of pressing needs and traditional values which is reflected in national-state interests - a multidimensional and multifaceted phenomenon which is an organic part of political reality. The elaboration of the doctrine of national-state interests is the starting point of any rational state strategy. The lack of clear ideas about interests turns the domestic and foreign policies of the state into a disorderly, chaotic set of actions dictated by the current conjuncture, which in the aggregate have a negative effect. The national-state interests of Azerbaijan have become a mandatory item of the programs of the vast majority 300

The press discusses the nature, genesis and essence of national-state interests, the problem of the bearer of national-state interests and who is responsible for their implementation; whether it is possible to optimize the process of elaborating and realizing national-state interests; what can be the optimal mechanism for coordinating the interests of an individual state with the interests of other countries and the international community as a whole, and so on. However, according to many authors, there is hardly a more or less clear understanding of what is generally understood under the national and state interests, although certain categories of state interests, for example, in the security sphere, are thoroughly worked out. Although at the state level, the process of determining and formalizing the national-state interests of Azerbaijan is quite active today, however, effective normative methods of comparing the disparate, sometimes mutually exclusive interests and aspirations of various groups of people and individuals, as well as the constitutional mechanisms for consolidating and aggregating the interests of the entire Azerbaijani society, have not been sufficiently studied so far. The very system of power and government in the state can be characterized as optimal only if it allows, among the set of existing social interests, to identify and elevate to the rank of state institutions that is
universally valid, which is objectively inherent in these interests and at the same time create the conditions for realizing the different interests of different social groups and individuals. The correct definition of the most vital interests has a direct consequence for the practical survival of the state. The problem of national-state interests is in this sense one of the fundamental problems, without the development of which a correct understanding of the functioning of the mechanism of the state is difficult. Лейла Алиева executive and judicial power, in whose activities national-state interests “materialize” - are respectively formed, implemented and protected, depends on the degree of development of this problem. The processes taking place in such a complex organism as the state can not be analyzed outside the category of “interest”, and the very purpose of various state institutions can and should be explained precisely through the essence and content of the category of interest. 302 |
