Sommario
Per le minoranze nazionali e linguistiche le politiche di gestione della diversitá lingüistica applicate dagli enti pubblici rivestono fondamentale im-portanza, poiché ne condizionano la conservazione e lo sviluppo. La presente monografía svolge un analisi di tali politiche mettendole in relazione ai modelli teorici contemporanei applicati alia gestione della diversité. Esse si collocano all’interno del fenómeno di revival étnico presente in Europa come conseguen-za della globalizzazione, dei processi d’integrazione europea, delle dinamiche della société postmoderna e delle trasformazioni del ruolo e dellorganizzazione degli Stati nazionali post-tradizionali. A livello filosófico-ideológico, la gestione della diversité lingüistica si ricollega al multiculturalismo e agli approcci teorici sullautonomia culturale e amministrativo-politíca delle minoranze nazionali nei modelli statali decentralizzati.
Capire il rapporto tra i concetti di Stato e nazione è essenziale per comprendere Fatteggiamento adottato dallo Stato italiano e dalle sue regioni, province e comuni nei confronti delle minoranze nazionali e linguistiche. 11 concetto di nazione italiana, infatti, non supporta la diversitá etnico-linguistica dello Stato italiano: dopo la sua creazione nei 1861, questultimo si è evoluto in forma cen-tralistica basandosi sulEidea di nazione italiana nata dal Risorgimento e dai suoi ideatori. Con Fawento del Fascismo, nei XX secolo essa ha vissuto una profonda crisi. II Fascismo ha infatti legato il concetto di nazione alFidea di dittatura e alie politiche di assimilazione, contribuendo a creare diffidenza verso il dibattito su etnícitá e nazionalitá a livello politico e statale. Questa tendenza si ritrova anche nei Dopoguerra, quando in ámbito politico e intellettuale si esaurisce il confronto

sul concetto di nazione con minore interes se per le problematiche minoritarie. La questione délia nazionalità si pone nuovamente negli an ni Novanta sotto F influenza di movimenti che promuovono i dialetti e le identitá locali e regionali, e di pressioni esercitate per migliorare lordinamento sulla tutela delle mino-ranze nazionali e linguistiche. A livello politico, il fenómeno della Lega Nord ha riproposto la questione delLunità dello Stato nazionale e dell’identitá italiana, escludendo pero la protezione delle minoranze nazionali.
Dopo 1 unificazione nel XIX secolo, lamministrazione pubblica italiana si è sviluppata sul modello di Stato centralizzato tendente albomogeneizzazione culturale e lingüistica, prendendo spunto dai concetti classici di Stato e nazione italiana. II sostegno al pluralismo linguistico, infatti, era una minaccia per la stabilitá dello Stato. Questo problema ha cessato di esistere subito dopo il 1948, quando Lltalia ha inserito nel proprio ordinamento democrático costituzionale il sistema degli enti locali composto da regioni, province e comuni, che comunque non attribuiva grande importanza alia composizione étnico-lingüistica dei terri-tori. Negli ultimi decenni questo modello si è modificato con un decentramento delle competenze statali a favore degli enti pubblici locali avvicinandosi in tal modo agli ordinamenti statali federali, benché le riforme non si siano comunque ispirate alia gestione della diversità. Ne consegue che lordinamento della pubblica amministrazione italiana non supporta la diversità lingüistica, anche se nel passaggio tra XX e XXI secolo vi sono State importanti novitá nelbuso pubblico delle lingue minoritarie e regionali.
Nel passaggio al XXI secolo, infatti, Lltalia ha introdotto un quadro giuridi-co di protezione delle minoranze che consente di gestire la diversità lingüistica negli enti pubblici locali quali regioni, province e comuni. A ció ha contribuito lapprovazione della legge di tutela delle minoranze linguistiche storiche n. 482/1999, della legge di tutela per la comunitá nazionale slovena n. 38/2001 e di alcune riforme che hanno decentrato le funzioni e competenze agli enti locali, anche in materia di tutela delle minoranze nazionali e linguistiche. Nello Stato italiano contemporáneo, quindi, le regioni, le province e i comuni hanno acqui-sito un ruolo importante per la conservazione e lo sviluppo delle minoranze in quanto rappresentano gli attori locali che contribuiscono alla formulazione e realizzazione della política statale. Le lingue minoritarie e regionali sono State cosí affidate alia gestione degli enti pubblici locali nei territori comunali multilingui. Si tratta di un passo importante benché, in base alia legislazione statale, le lingue minoritarie o regionali non siano diventate lingue ufficiali dello Stato o degli enti pubblici locali multilingui. A livello concreto, il nuovo sistema introdotto ha fatto

emergere una serie di lacune e non si è rivelato del tutto efficace nel promuovere l’uso pubblico delle lingue minoritarie e regionali.
In Italia, la Regione Autónoma Friuli Venezia Giulia (FVG) rappresenta un caso particolare, poiché, fin dalla sua fondazione negli anni Sessanta del secolo scorso, ha affrontato il tema délia pluralità nazionale e lingüistica presente sul suo territorio con le minoranze slovena, friulana e germánica. Lordinamento amministrativo prevede unautonomia che, in origine, era in realtà più Iegata a nécessité economiche e politiche che a tematiche di diversité nazionale e lingüistica. Oggi, grazie al contesto económico sviluppato e ai processi d’integrazione europea, ¡’autonomía si manifesta principalmente in tematiche legate alia presenza delle tre minoranze nazionali e linguistiche riconosciute.
11 caso studio ivi proposto sulla gestione délia diversité lingüistica in Regione FVG presenta in prima battuta lordinamento delle strutture regionali, provincíali e comunal!, ovvero 1 apparato istituzionale preposto all’attuazione della tutela delle minoranze slovena, germánica e friulana. II caso studio fa inoltre una panorámica sullo sviluppo storico, la struttura organizzativa e 1 attivitá delle tre minoranze in oggetto che si differenziano per status, caratteristiche, struttura, storia e modalité di espressione degli interessi. Ció che le accomuna è la presenza storica sul territorio in cui oggi vivono.
La presente monografía si concentra poi sulle novité introdotte dalla legi-slazione statale e régionale sulla tutela delle minoranze storiche. In particolare vengono presentati i contenuti di tre leggi regionali, ovvero la legge régionale n. 26/2007 di tutela della comunité slovena, la legge régionale n. 29/2007 di tutela della comunité friulana e la legge régionale n. 20/2009 di tutela delle comunité di lingua tedesca. L’analisi delFapplicazione della normativa si concentra sull uso dello sloveno, del friulano e del tedesco in regione, nei comuni e nelle province da parte dei dipendenti pubblici, che utilizzano le varie lingue in forma scritta e orale nelle proprie attivité. Questi soggetti hanno raccontato la propria esperienza in materia neU’ambito di una serie di interviste qualitative da cui sono emerse le attivité svolte, i punti deboli e le buone pratiche di gestione delle minoranze nazionali e linguistiche in Regione FVG. Da ció si evínce che íl sistema di gestione della diversité per le tre minoranze nazionali e linguistiche riconosciute si fonda sulla loro autonomia culturale. Non si rilevano forme di autonomía territoriale, di autogestione delle minoranze o di divisíone del potere tra il gruppo nazionale maggioritario e i gruppi nazionali e linguistici minoritari, come invece previsto dai modelli teorici contemporanei di gestione della diversité. Il sistema di gestione della diversité lingüistica, inoltre, garantisce alie tre minoranze riconosciute i diritti culturali e di eguaglianza, pur rimanendo deficitario in materia di diritti

di autogestione e di rappresentanza. Esso, infine, non prevede lapplicazione dei diritti collettivi delle minoranze nazionali e linguistiche, che permetterebbe di riconoscere non solo le identitá culturali ma anche quelle politiche delle comunitá minoritarie nella Regione FVG.
In Italia, quindi, la promozione dei principi interculturali di gestione degli enti pubblici é un processo tuttora in corso. Sono giá stati mossi i primi passi verso luso delle lingue regionali e minoritarie alEinterno degli enti pubblici locali, che svolgono un ruolo primario nella tutela delle realtá minoritarie e pertanto sono, nel contesto legislativo europeo e italiano contemporáneo, gli attori fondamentali delle politiche di gestione delle minoranze nazionali e linguistiche.

Summary
Th e politics of the management of linguistic diversity by public local administrations are fundamental for national and linguistic minorities because they influence conservation and development. In this monograph they are treated within the frame of contemporary theoretical models of diversity management. They are also discussed in relation to the phenomenon of ethnic revival on the European level as a consequence of globalization, European integration processes, the dynamics of post-modern society and changes in the role and organisation of the post-traditional national state. On the philosophical-ideological level, diversity management relates to the debate on multiculturalism and on the theoretical approaches concerning the cultural and administrative-political autonomy of national minorities in the models of state decentralisation.
Understanding the relations between the concepts of state and nation in Italy is the basis for an understanding of the approach of the Italian state and its regions, provinces and municipalities towards its national and linguistic minorities. The concept of the Italian nation does not support the linguistic and ethnic diversity of the Italian state. From its very beginning in 1861, the Italian state developed in a centralised way on the basis of the idea of the Italian nation which was influenced by the Risorgimento and its ideological leaders. This idea found itself deep in crisis under the fascism of the twentieth century. Fascism developed such that the concept of nation became related to the dictatorship and politics of assimilation which resulted in distrust regarding the debate on ethnicity and nationalism at political and state levels. This continued in the post-war period when the confrontation with the concept of nation on the intellectual and political

level died out and contributed to the lack of attention regarding the minority issue. On the ideological level, the issue of nationality arose in the 1990s under the influence of the movements for the revitalisation of dialects and local and regional identities as well as pressure for better regulation of the protection of national and linguistic minorities. On the political level, the phenomenon of the Northern League party once again posed the question of the unity of the national state and the Italian identity, but did not take into consideration the issue of the protection of national minorities.
The Italian public administration developed from the unification onwards in the 19th century on the basis of the centralised state model which aimed at cultural and linguistic homogeneity following the construction of the classical national state and the Italian nation. The support of linguistic and ethnic pluralism was perceived as a threat to the stability of the state. This problem no longer existed just after 1948 when Italy included a system of local administrations based on regions, provinces and municipalities in its constitutional democratic organisation. Even in this political-administrative arrangement, the mixed national and linguistic settlements of the regions, provinces and municipalities were not in the forefront. This model has in recent decades changed towards decentralisation of the state competencies to local public administrations and thus become closer to the federal state systems. However, these reforms were not based on elements of diversity management. Thus, the Italian system of public administration does not support linguistic diversity. However, important changes were observed upon the transition to the 21st century on the level of the public use of minority and regional languages.
At the beginning of the 21st century, Italy introduced a legal frame concerning minority protection which allows the management of linguistic diversity in public administrations such as regions, provinces and municipalities. It was implemented with the approval of Law 482/1999 concerning the protection of historical linguistic minorities, the protection law for the Slovene national community 38/2001 and some reforms which allowed the decentralisation of functions and competencies from the central state to the local administrations also in the field of safeguarding national and linguistic minorities. Regions, provinces and municipalities thus have an important role in the conservation and development of minorities in the contemporary Italian state as they contribute to the shape and realization of state policies. Minority and regional languages were, upon the transition to the 21st century, included in the official workings of local public administrations in those municipalities which identify as multilingual. This represented an important step concerning the introduction of the management of

linguistic diversity in the local public administrations. However, nowhere in the state legislation were the official, regional or minority languages defined, either by the state or local public administrations in the multilingual areas. The system which was introduced has some weaknesses in practice and it is not entirely effective in the promotion of the public use of minority and regional languages.
The Friuli Venezia Giulia (FVG) autonomous region is a special case in Italy because it has dealt with national and linguistic pluralism since its establishment in the 1960s related to the presence of the Slovenian, Friulian and German minorities. Its administrative organisation provides for autonomy which was originally more an expression of economic and political need than national and linguistic diversity. Its autonomy is now more connected with the presence of the three recognized national and linguistic minorities because of the developed economic position and the European cross-border integration processes.
The case study of the management of linguistic diversity in the FVG region presented in this monograph shows first of all the organisation of its regional, provincial and municipal structure. This is the institutional framework which applies the safeguard of the Slovene, German and Friulian minorities. The case study also provides an overview of the historical development, organisational structure and activity of these minorities. They differ from each other concerning their position, characteristics, structure, history and expression of community interest. The common feature is their historical presence in the area in which they now live.
The case study also focuses on the new provisions which were introduced by the recent state and regional laws concerning the protection of historical minorities. Particularly, it presents the contents of the recent regional laws, the regional protection law for the Slovene community 26/2007, the regional protection law for Friulian community 29/2007 and the regional protection law for the German speaking minorities 20/2009. The analysis on the implementation of this legal basis regards the public use of the Slovene, Friulian and German languages in the region, provinces and municipalities. It considers the point of view of the employees in the selected local administrations who use the three languages in oral and written form while conducting the activities of the public administration. This was discussed by employees in a series of interviews which showed the realised activities, weaknesses and best practices in the field of the management of the national and linguistic minorities in the FVG region. Note that the system of diversity management of the three recognised national and linguistic minorities is based on cultural autonomy. It has not developed the territorial autonomy, self-governments of the minorities or forms of power sharing between the national

majority and different minority national and linguistic groups which are required by the contemporary theoretical approaches concerning diversity management. This system of the management of linguistic diversity grants the right to equality and cultural rights to the three recognised minorities, but it is weak on the level of the right to self-government and representation. Moreover, it did not include the transition from individual to collective rights for the national and linguistic minorities which will enable the recognition not only of the cultural, but also of the political identities of the minority communities in the FVG region.
The introduction of intercultural management principles of public administrations is an ongoing process in Italy. The first step towards the use of regional and minority languages in the operation of local public administrations have already been taken.
