Résumé
The period
of
Rudolf
II was in the history of Czech lands one of the greatest
periods for the effort of the Czechs to create conditions for free thinking about
all aspects of human life and his position within the society. During this period
two Europe-wide philosophical directions culminated (and began to fade
away); reformation and renaissance. These philosophies were announcing the
coming of a new economic, social and political era.
Reformation represented a massive people s movement for religious reform
that started in the Czech lands with the Hussite movement and a hundred
years later (around
1520)
reached as a storm most of Europe. There were cre¬
ated many new churches that presented themselves as the preachers of the
new Gospel, renewal of the first religion, return to
fontes
-
clean springs of
the biblical Christianity, without the imperfections of the current period and
the evils of the church.
Renaissance opened the door to new ways of thinking about the nature,
man, society, morality, law and political organization, including religion, arts,
literature and music. It expressed and stimulated the disintegration of relati¬
ons and the growth of economic, political and cultural-ideological basis for
the future society. Its main goal was to emancipate scientific thinking and
understanding, to free it from the bonds of scholasticism and medieval te-
ocentrism and to create new understanding of the world and man based on
natural ways of thinking that would allow increasing the power of the indivi¬
dual over the nature and over his own world.
Reformism, as well as renaissance, was essentially entwined with humanism
(from Latin
humánus
-
humane) that in various ways attributed the central
role to the man, his dignity, well-being, needs and interests.
Between the 15th and 17th centuries the way justice was expressed in formal
visual and sculptural works began to be perceived in connection with the na¬
tural law; a concept appearing frequently also in the legal theory and practice
of the Czech monarchy. In general, natural law of this period is understood in
connection with the terms justice and general welfare . Rather vague term

refers, as it was in ancient Greece and Rome, to the benefit
for the community (sometimes it has also a theological connotation and is
connected with the application of Christian virtues). The aim of the govern¬
ment is to create good conditions for the life of those who live in the commu¬
nity, i.e. for the community itself. Naturally, the general welfare depends on
the subjective perception of those that interpret it. The general welfare was
built on the meaning of the word justice which was influenced by the legacy
of ancient Greece and Rome.
Humanism, including legal humanism, was coming forward in the Czech
lands where it witnessed the encounter between Czech Utraquism and Catho¬
licism. Only a gradual development led to the religious tolerance of the 16th
century that positively influenced the exchange of ideas. This new plurality
brought an end to the conflict between the catholic Romanian world and the
protestant
German world within the Czech lands between the twenties and
forties of the 17th century.
The influence of humanism on the development of legal thinking in the
Czech lands is traditionally divided into the internal and external area. The
external area means appointing humanists into positions, from which they
could influence legal practice, such as: higher municipal or central clerks.
These positions required individuals with basic qualification, which was not
formally required at that time. As soon as humanism prevailed, such persons
began to show interest in positions, from which they could immediately in¬
fluence and create legal practice. The internal influence of humanisms was
manifested directly in legislative actions.
Due to its political, confessional and economic focus, the society during
the rule of Rudolph II required the services of many educated men also for
municipal and patrimonial administration. The requirements on these men ex¬
ceeded what little education could be offered by city schools or the private
teachers of the aristocrats. The level of education was also one of the factors
that separated the elite from the rest of the population and opened the door
to the higher levels of society.
In the second half of the 16th century, the lifestyle of the aristocracy chan¬
ged dramatically. The primary social requirement for an aristocrat was educa¬
tion. Bigger families had their private teachers, many of whom were great
scholars. University education in the area of law was a rule.
The authors also look into the judicial system, especially the system of
courts of law during the era of Rudolph II, because especially there jurists em¬
ployed their education and knowledge.

Another part of the work is dedicated to the great persons of the second
half of the 16th and early 17th century, educated in the area of law, which was
at that time only possible by self study. The university founded by Charles
was at that time limited to the faculty of arts. Juristic education could also
be obtained by practice in one of the official functions. Some students, of
course, received their education on foreign universities, especially in Germany
and Italy.
In the second part of the work the authors offer brief medallions for each
jurist and every medallion also contains a short example of his work. It is the¬
refore an anthology of its kind that aims to introduce to the reader, at least
partially, the contributions of these jurists to the excellent legal culture of
that time.
The authors hope that this book will find its readers who will find know¬
ledge and enjoyment in it.
