Zusammenfassung:After the French Revolution, under the influence of the theories promoted by Rousseau and Montesquieu, France had been setting restrictions on the delegated legislation. Therefore, law had been prior to administrative decree. In the meantime, with the expansion of government affairs, the role of administrative decree in the legal system had become increasingly significant. Especially due to the strict restriction of rules of law stipulated by The Constitution of 1958, various types of administrative decrees had emerged in great numbers. The supervisory capacity over administrative decree of French Parliament had been gradually weakened; the supervision of administrative court managed to ensure the orderly development of administrative decree.
