Zusammenfassung:In the well-known Gai. 3,146 the literature identifies a mixed or atypical contract. It is a complex text in which various institutions concur, such as the condition. The present study aims to demonstrate how a dogmatizing approach does not lead to fully acceptable interpretative results. Therefore, the possibility arises that the jurist antoninus summarized, for didactic purposes, an example of the numerous Hellenistic negotiations, which the papyrus sources attest to in large numbers, drawn up in an environment not bound to the Typenzwang, but which the Roman scientia iuris manages to convey within the framework of typical contracts.
