Zusammenfassung: | National regulatory framework is one of the important components to support the development of the security system for radioactive materials out of regulatory control (MORC). The adequacy of the provisions contained in existing national legislation and regulations needs to be reviewed to ensure the level of strength and completeness as a legal basis for the development of the security system. Currently, study on the adequacy of the national law especially regarding the nuclear security is very rare to find. A study to evaluate the national laws and regulations as legal provisions for the development of the security system for MORC has been done. The study was conducted using a descriptive-analytical method based on international standards and agreements, and other related national laws and regulations. The objective of the study is to identify and analyze the gap between the provisions relating to the security of MORC which are available in the national legislation system and those required based on the international standards. The analysis was carried out on a set of laws and regulations related to nuclear security, ranging from laws, government regulations to BAPETEN regulations. The results show that there are still some lacks in provisions specifically on establishment of the competent authorities, mechanism of coordination between competent authorities and interested parties, and determination of penalty of law violation relating to unauthorized own, use, transfer of radioactive materials. It is, therefore, recommended to improve urgently the laws and regulations through revising some existing or preparing the new ones by adding the provisions lacking in the existing laws and regulations. |
