新冠肺炎疫情期间,为保障教学秩序与师生的生命安全,美国高校纷纷将面技教学改为在线教学。但学生却认为,在线教学质量低下,无法与面提教学媲美,由此爆发了大规,模在线教学案件。通过分析107件美国高校在线教学案件可以发现,案件争议焦点主要聚焦于将面技教学改为在线教学是否涉嫌教育失职、不当得利、违反合同、侵和权益和财政转移等问题。虽然由于各州法律、判例、法官研判等原因,案件的审判结果略有差异,但是各类案件的核心问题均在于美国高校学生认为在线教学的质量远低于面技教学。新冠肺炎疫情作为典型的黑天鹅事件,凸显了美国高校在线教学的质量保障与质量评价问题...
