VIOLENCIA CONTRA A MULHER: A PARTICIPACAO DA VITIMA PELAS VIAS RESTAURATIVAS COMO QUESTAO DE DIREITOS HUMANOS/VIOLENCE AGAINST WOMEN: The victim's participation through restorative ways as a human rights issue

O artigo apresenta como hipotese se a falta de participacao da mulher na construcao do provimento jurisdicional pode ser encarada como uma forma de violencia de genero? A proposicao cientifica envolve a aplicacao de praticas restaurativas como instrumento capaz de empoderar a mulher nos casos envolvendo violencia domestica. Como resultado alcancado verifica-se que o arcabouco juridico forneceu os fundamentos que concluiram pela possibilidade de legitimacao da participacao feminina na construcao da resolucao de conflitos. A pesquisa e de natureza teorico-bibliografica seguindo o metodo dedutivo, cobrindo as modificacoes legislativas ocorridas desde de 2002 (ano em que a ONU editou a Resolucao no 12/2002 sobre Justica Restaurativa) ate 2022. The article presents as a hypothesis whether the lack of participation of women in the construction of jurisdictional provision can be seen as a form of gender violence? The scientific proposition involves the application of restorative practices as an instrument capable of empowering women in cases involving domestic violence. As a result, it appears that the legal framework provided the foundations they concluded for the possibility of legitimizing female participation in the construction of conflict resolution. The research is theoretical-bibliographic in nature following the deductive method, covering the legislative changes that took place from 2002 (year in which the UN issued Resolution 12/2002 about Restorative Justice) until 2022.
