description The objective of this article is to reflect on the media discourse of "zero tolerance" and its impact on the performance of the Judiciary and institutions of state repression. Estimates from the Brazilian Criminal Police Department (Depen) show that the imprisoned population in Brazil will reach 1.5 million people in 2025, justifying the debate in view of the increase incarceration in the country. In this article, based on the analytical-deductive method applied to the theoretical reflection on the literature referring to Criminal Law and Criminology, it is argued about the dissemination of the discourse of "zero tolerance" is the modus operandi of state authorities, which is praised and propagated by the sensationalist media and influencing the behavior of judges, courts, courts and the very institutions of state repression to the detriment, sometimes, of the protection of constitutional rights. O objetivo do artigo e refletir sobre o discurso midiatico de "tolerancia zero" e o seu impacto sobre a atuacao do poder Judiciario e das instituicoes de repressao estatal. Estimativas do Departamento de Policia Penal (Depen) mostram que no Brasil, ate 2025, a populacao carceraria chegara a 1,5 milhao de pessoas, justificando-se o debate pelo aumento do encarceramento prisional no pais. Neste artigo, a partir do metodo analitico- dedutivo aplicado a reflexao teorica sobre a literatura especializada do Direito Penal e da Criminologia, discute-se a disseminacao do discurso de "tolerancia zero" como modus operandi das autoridades estatais. Esse discurso e fruto da apologia da cobertura sensacionalista adotada pelos meios de comunicacao que abordam os crimes; alem disso, esse discurso influencia o comportamento de juizes, tribunais, cortes e das proprias instituicoes de repressao estatal, as vezes em detrimento da protecao dos direitos constitucionais.
