Sustenta que o congestionamento judiciario e fator relevante no dimensionamento da prisao processual. Metodologicamente, o artigo se vale de pesquisa juridico-exploratoria e analise documental--esta ultima a partir dos dados disponiveis de uso da prisao no Brasil.
