Zusammenfassung:	PURPOSE: A nonaqueous electrolyte battery is provided to restrain an excess rise (or drop) in the potential of a positive electrode by limiting the ratio of the capacity change in the positive electrode opposed part to the capacity change in the negative electrode opposed part. CONSTITUTION: A nonaqueous electrolyte battery(20) comprises: a positive electrode comprising a positive electrode current collector and a positive electrode layer formed on at least one surface of the positive electrode current collector; a negative electrode comprising a negative electrode current collector and a negative electrode layer formed on at least one surface of the negative electrode current collector;a separator interposed between the positive electrode and the negative electrode; and a nonaqueous electrolyte, wherein the negative electrode layer comprises a negative electrode active material which can absorb and release lithium ions at a negative electrode potential of 0.4 V (V.S.
