Pesquisando, adquirindo e consumindo produtos da pós-modernidade: judicialização, neojulgadores e self-service normativo

In face of a postmodern context, it becomes necessary to consider the role of the Judiciary Power in a society marked by immediacy claims in which the utilitarian aspect of judicial decisions is gaining sympathy of people living under the law with the satisfaction of their interests. While risks from this practice remain outlined, the importance of the tradition of the legal dogmatic in an era marked by social insecurity can be envisaged. Diante de um contexto Pós-Moderno, torna-se necessária uma reflexão sobre a atuação do Poder Judiciário numa sociedade marcada por pretensões imediatistas, aonde o aspecto utilitarista das decisões judiciais vem ganhando a simpatia do jurisdicionado quando da satisfatividade de seus interesses. Ao restarem esboçados os riscos provenientes dessa prática, é que poderá se vislumbrar a importância da tradição da dogmática jurídica numa época marcada pela insegurança social
