Zusammenfassung: | This Article aims to set out the most important aspects of optional territorial jurisdiction resulting from
the provisions of art. 127 from Civil Procedure Code, by analyzing the amendments made following the
publication of the Constitutional Court Decision no. 290 of 26 April 2018 on the exception of unconstitutionality of the provisions para. (1) and (2) of the article under consideration. The decision mentioned has particular interest given that it was intended to align legal provisions with constitutional provisions, thus ensuring respect for the fundamental rights of the parties involved in the disputes. Compared to the regulations of the first form from Civil Procedure Code, the current provisions reflect a positive development in the direction of protection of citizens' procedural rights, free access to justice and equality before the law. |
